1. Introduction
Welcome to Bay Area K9 Adventures (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website bayareak9adventures.com and our 1-on-1 dog hiking, transport, and pet care services (“Services”). By booking a service, purchasing a package, or using our Site, you agree to comply with and be bound by these Terms.
2. Services Overview
We provide specialized 1-on-1 mountain hikes, outdoor transportation, and post-hike care designed for athletic and high-drive dogs. All hikes are conducted on a strict 100% on-leash lead utilizing clear communication and handling tools.
All Services are subject to availability, client screening, weather conditions, and ongoing behavioral/safety assessments.
3. Client Responsibilities
As a client, you agree to:
Provide accurate and up-to-date contact info, home access instructions, and pet health/behavior history.
Ensure your dog is current on all legally required vaccinations (Rabies, DHPP, Bordetella) and actively maintained on flea, tick, and heartworm preventative treatment.
Fully disclose any known triggers, behavioral concerns, or history of reactivity/aggression.
Provide safe, reliable access to your residence for scheduled pick-ups and drop-offs.
We reserve the right to refuse, suspend, or terminate service at our sole discretion if a dog or environment poses an unmanageable safety risk to the dog, handling staff, or the public.
4. Booking, Rates, & Payments
Standard Pricing: Rates for individual adventures and multi-hike packages are listed on our booking portal and are subject to change with advance notice.
Payment Terms: Payment is due at the time of booking via credit/debit card (processed securely through Square) or approved invoice prior to service delivery.
Packages & Bundles: The 4-Adventure Bundle provides discounted single-adventure rates. Bundle purchases are non-transferable and must be redeemed within 6 months of purchase.
5. Cancellations, Rescheduling, & Refunds
Client Cancellations: Cancellations or rescheduling requests made at least 24 hours prior to the scheduled pick-up time will receive a full refund or service credit. Cancellations made with less than 24 hours' notice may be charged the full service rate.
Weather & Safety Rescheduling: In cases of severe heat, heavy rain/flooding, poor air quality (smoke), wildfire risks, or closed trail conditions, Provider reserves the right to reschedule hikes for the dog’s safety without penalty to either party.
6. Health, Safety, & Emergency Care
While we enforce strict safety protocols, outdoor trail activities carry inherent environmental risks.
In the event of a medical emergency on the trail, you authorize Provider to seek immediate veterinary attention at the nearest emergency facility if you or your emergency contact cannot be reached.
You agree to assume full financial responsibility for all veterinary costs, emergency transport, and medical treatment expenses incurred on your pet’s behalf.
7. Liability Waiver & Indemnification
Participation in our Services is contingent upon signing our full Client Liability Waiver and Release. By booking services, you acknowledge that you have reviewed and signed the waiver, agreeing to release Bay Area K9 Adventures from liability except in cases of proven gross negligence or willful misconduct.
You agree to indemnify and hold harmless Provider from any claims or financial damage caused directly by your pet's actions during the provision of Services.
8. Media & Content Release
Photos and videos taken of your dog during hikes, transit, or care may be used for marketing, social media, and website updates. You may opt out or revoke this permission at any time by notifying us in writing.
9. Privacy Policy
Your privacy is extremely important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.
10. Termination
Either party may terminate service arrangements at any time upon written notice. Unused individual single-hike credits will be refunded. Unused package balance refunds will be calculated based on the full standard single-hike rate for any already completed hikes.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal proceedings or disputes arising under these Terms shall be handled exclusively in the state courts located in California.
